This is actually what should occur here in Australia so victims can relieve their torment on the offender to aid in their recovery. But at least in most states of USA we can rely on just sentencing. DO NOT EXPECT JUST SENTENCING IN VICTORIA. We have to thank the assistance from our victims organisations who tirelessly and usually volunteering assist victims of many crimes to relieve some of their pain and promote healthy rehabilitation. This should be another issue just like there are many issues pertaining to law and order for any of the governments to consider through petitions and submissions to parliament.

This is another case for all parole boards adult and juvenile in all states to be reviewed. The three SKAT brothers deserved their sentences and NO PAROLE. This is pathetic. What also needs to happen if people do not respect Australia or our laws etc, then after they finish their prison time deport them not like one of hte offenders who killed Dr CHANG who was released on parole and sent straight back to his homeland. Typical political rubbish. The Federal Gov’t need to get real pertaining to the revocation of citizenship and certainly enforce, No parole for offenders such as these brothers. There are many more offenders just like them who do not deserve parole. I would like to see families including victims take a class action against the Government and Parole Board for recidivist offenders who should not get parole or who breach parole and commit serious crimes.
We will wait and see.

This sentence by the third offender is still not a just sentence for the victim. People need to know that if this offender breaches his I.C.O or any other order which are punishable by imprisonment the offender may only receive a minor increase in a sentence but will not receive a just sentence if he breaches it. Again this is a case where as a crowd controller should have received a severe sentence as they are deemed to know the law pertaining to assualt. We hope that Mr. HULLS wil raise the Crimes Comp from $10.000 which has just been amended. This is a pathetic amount and I sincerely hope the victim sues the offenders to receive some justice.

Hooray Hooray! Mr DOHERTY of Broadmeadows Magistrates Court should be treated in the same light as Mr KUMAR from the same court and former Justice Phillip CUMMINS who attempt to provide actual justice to victims and the community by jailing offenders such as this offender. If it was any other Magistrate at most other courts and including Mr DOHERTY from Sunshine Magistrates Court then do not get your hopes up with a just sentence. We have to wait and see which political party will win the election this year to determine what promises will hopefully be kept and the many other promises that will not be kept. Please write into Mr. BAILLIEU and Mr. HULLS our current Attorney General for changes and to ensure on this topic that the Government oversees the running of governement employees but all members of emergency services and Magistrates, Judges, Justices are appointed on their own merit by their peers.

It appears that some judges are not only out of touch but untouchable! While traditionally judges have needed to be impartial, independent and appear dispassionate so as not to be influenced by subjective community values and views, tradition and logic does not dictate that they are there to give effect to the will of the community. At first sight, it is worth the community acknowledging that judges have never merely been administrators of the law despite attempts to be represented as such. Like other humans, they have values and see things through their personal lens.

On the issue of Kontoklotsis sentence, he received a 12 month intensive corrections order and avoided a prison sentence, despite being the main character in the attack. Why you may so wisely ask? Because he is a primary carer for his mother. While it may appear that Mr. Howie has undervalued the seriousness of the case as only 1 person was seriously injured, what may have been overlooked has been that that individual has a family, a caring and loving mother, a future, a career, some contribution to make to society. Would the justification for the sentence handed down by Howie been any different if Kontoklotsis had of injured more than 1 person so severely in the attack? These people (and yes I mean ‘these’ in the sense that they do no belong in society until they are rehabilitated) are dangerous and compromise other innocent, law-abiding peoples ability to exercise their freedoms – the freedom to security, the right to be able to walk on the street WITHOUT FEAR of attack and the right of the youth bashed to be able to lead a normal healthy life.

Justice has become an overused catchphrase that has lost its place in Mr. Howie’s practice. It highlights that Judges need more than a university education and need an education on humanity and compassion for victims and the wider community. But then again, what is justice – a prison sentence aimed at keeping the community safe or rehabilitation…ultimately it would involve both in this particular context.

It’s really difficult to be objective about the processes in the criminal justice system after watching the video of the youth bashing and seeing blood poor out of the victims skull.

This is another broken promise to amend the provocation sentencing. Mr HULLS a lawyer himself does not care very much for any victim let alone women. Until the sentencing provisions are reviewed by competent victims, police, Magistrates, Lawyers and so on who are the members of the Sentencing Advisory Council then nothing will change. We need the public to act just like in the news with police numbers over 7000 signatures for the government to act. Also finally the High Court has enlightened some victim’s lives by refusing notorious murderer Peter DUPAS the right challenge his murder trial pertaining to the murder of Ms HALVAGIS in 1997. DUPAS is a person who should never be released from prison, just one of many.
