The Attorney General Rob hulls has come out in the media and demanded Judges be more accountable for the decisions they make with regards sentencing but this outburst seems a bit rich when one considers that this is coming from a man who has himself appointed more left wing social justice civil libertarians onto the bench than any of his predecessors. Inconsistency is the word one would have to use for our Justice system, as many of the sentences are not in line with public acceptance and it all comes down to the interpretation of the Judge sitting on the case.

The case concerning former North Melbourne footballer David Dench has highlighted just what a lot of people had always thought and that is, it is far more serious to defraud the taxman than it is to defraud an individual or an Education facility. Dench was part of an elaborate scheme that dishonestly invoiced the VUT Footscray for work and materials that were either never provided or went to another address. This scam was worth over a million dollars but somehow Dench only got 4 months jail with the balance suspended even though he fought the charges all the way with no guarantee he would be able to pay it back. Now consider the sentence given to Glen Wheatley for his indiscretion of taking $300k from the Taxman, which was by the way paid back with interest along with a guilty plea and full disclosure of his avoidance scheme and you would have to ask WHY THE DIFFERENCE IN SENTENCE. How does someone get to serve 18 months jail/home detention for co-operating with authorities and another get 4 months ONLY for denying his involvement in an elaborate form of theft is beyond me.

How refreshing was it to read about a Magistrate so disappointed with thuggish behavior that she decided to jail a footballer for king hitting an opponent during a game. Magistrate Spencer decided that Trent Stanimirovitch had exhausted his chances because of a previous conviction for assault and the seriousness of his attack on an opponent from behind which resulted in serious facial injuries to the victim. She jailed this rocket scientist to 2 months as a consequence for his indiscretion and in doing so has sent a clear message to other Magistrates on the bench that they should now show some gumption when it comes to handing down proper sentences to thugs who think belting someone is the way to sort out a problem.Bravo

It is amazing how many times we read about some poor unfortunate individual not being given a chance to get on with his life because of their treatment by the media and the public in general. Take Dennis Ferguson for instance, one of Australia's worst pedophiles. He was due to stand trial for the alleged sexual assault of a five-year-old girl in her home back in November 2005 but because of media coverage about his past, District Court Judge Hugh Botting dismissed charges against him, because in the views of the judge, Ferguson had received to much media attention to allow him to get a fair and unbiased hearing. Now if the good Judge has a problem with the jury system let him come out and say so.

Judge Tony Howard this week had to decide what he would give two young men as a penalty for their reckless driving which resulted in the death of a young woman named Sharn Kelly, and unfortunately for the family he seems to have come up short with the term of the penalty.
